Terms of use

What applies between you and us when you use the TAMITOS Move app. Written so that it can be read once and understood.

The short version

  • You pay nothing. Ever. Not even hidden.
  • You move → you get points → you turn points into euros → the euros are paid by the month's partner, not by you.
  • Points are not your money. They cannot be cashed out, sold or transferred to anyone else.
  • Unused points expire on Sunday at midnight.
  • Once you have given, there is no way back, the money goes to the family.

1. What this is about

TAMITOS Move is an app in which your ordinary movement turns into money for the families of children on the autism spectrum, with ADHD and other neurodivergence.

A company or a foundation, hereinafter the month's partner, puts up a pot of money for that month. You move as you otherwise would, the app reads it from your watch or your phone and credits you with points. You turn the points into euros and choose which of the families they go to. The euros come out of the partner's pot.

2. You pay nothing

The app is free. There are no payments, no subscriptions, no adverts and no in-app purchases in it. We will never ask you for a card so that you can move and give.

Which brings with it the uncomfortable part: the money you give away is not yours. It is the partner's and you decide who it goes to. That is why it cannot be paid out to you.

3. Account

For points and for a record of who you have already helped, you need an account. You undertake to give a truthful e-mail address and not to lend your account to anyone. You are responsible for what happens through your account.

You can delete your account at any time. Your points cease to exist with it and cannot be restored.

4. Points

  • Points are calculated by the server, not by the app on the phone, and they are calculated from the intensity and the duration of the movement (MET minutes).
  • Manually entered activities earn no points. Both Health Connect and Apple Health mark what was written in by hand, and we skip records like that.
  • A daily cap applies. It is not mistrust, it is so that the monthly pot lasts for more people than the five most persistent ones.
  • Unused points expire at the end of the ISO week, that is, on Sunday at midnight Central European Time. The app says so in advance and writes the expiry into your history, so that it can be checked.
  • Points are not a means of payment, they are not a security, they have no monetary value, they cannot be cashed out, sold, given to another user or inherited.

5. Giving

How many euros a point is worth is set by the rate in force for that month; it is stored at the moment of the gift, so a later change of the rate does nothing to a gift you have already made.

A gift is final. It cannot be returned or cancelled, the money goes to the family and the family is counting on it.

When a family has been fully funded in the meantime, or the month's pot has been used up, part of the points comes back to you and the app writes why. You can see it in your history.

6. The leaderboard and rewards

The leaderboard is voluntary and is switched on separately. If the month's partner announces a reward for the best, the rules published with that particular challenge apply to it: who is giving it, what it is, until when it runs and how it is evaluated. Without published rules there is no reward.

The ranking is calculated exclusively by the server. An account that tries to influence the leaderboard fraudulently drops out of it and we will take its points away.

7. What is not allowed

  • passing off as movement something that was not movement, including attaching the phone to an animal, a drill or a washing machine,
  • interfering with the app, the server or the transmission of data,
  • creating multiple accounts in order to get more points,
  • using somebody else's account or somebody else's health data.

Suspicious records are flagged automatically by the system and looked at by a human. Where fraud is confirmed we take the points away and we may cancel the account. If it turns out that the flag was a mistake, we give the points back and we write to tell you so.

8. Availability and liability

We run the app as well as we know how, but we do not promise uninterrupted availability. Movement data comes from watches, phones and third party services and we cannot influence its accuracy.

TAMITOS Move is not a medical device. Nothing in it is medical advice and it is not meant to serve for diagnosis or treatment. If you have health limitations, consult a doctor before you change the way you move.

We are not liable for damage caused by the service having been temporarily unavailable, nor for indirect or consequential damage. This is without prejudice to the liability that cannot be waived under Slovak law.

9. Changes and termination

We may change these terms. We will notify you in the app of a substantial change before it takes effect. If you do not agree with it, you can delete your account.

We may cancel your account if you breach these terms. We will write to tell you the reason, unless the law prevents us from doing so.

10. Law and contact

The relationship is governed by the law of the Slovak Republic. Disputes are decided by the Slovak courts, which is without prejudice to consumer rights under the law of the country of the consumer's residence.

This is an English translation of a document written in Slovak. It is here so that it can be read, and we keep the two saying the same thing. Where they differ, the Slovak version is the one that applies.
